Terms of Service

These Terms of Service govern your access to and use of Listaily, including our website, dashboard, APIs, generated outputs, and related services.

By accessing or using Listaily, you agree to be bound by these terms. If you do not agree, do not use the service.

You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account.

If you use Listaily on behalf of a company or other entity, you represent that you have authority to bind that entity to these terms.

Listaily provides AI-assisted workflows for cross-border commerce content creation, including product listings, social copy, image card generation, templates, and related tooling.

We may update, improve, limit, or discontinue features at any time. Some features may be offered only on certain plans or in beta.

You may not use Listaily to violate law, infringe intellectual property or privacy rights, distribute malware, spam users, scrape the service, or interfere with system integrity or security.

You may not use the service to generate or distribute fraudulent, deceptive, defamatory, or unlawful product claims. You remain responsible for reviewing all outputs before publication.

You retain ownership of the text, images, brand assets, and other materials you upload to Listaily.

You grant us a limited license to host, process, transmit, and transform your content solely to operate, secure, and improve the service.

Subject to your compliance with these terms and applicable law, you may use the generated outputs produced for your account for your internal business purposes and customer-facing publication.

AI-generated content may be inaccurate, incomplete, or non-unique. You are responsible for human review, legal compliance, marketplace compliance, and final publishing decisions.

Paid plans are billed on a recurring basis unless otherwise stated. Fees are non-refundable except where required by law.

If payment fails or your subscription ends, we may downgrade, suspend, or limit access to paid features until billing is resolved.

Listaily, including its software, branding, interface design, and proprietary workflows, is owned by us or our licensors and protected by applicable intellectual property laws.

These terms do not grant you any right to use our trademarks, brand assets, or proprietary materials except as necessary to use the service.

The service depends on third-party providers, including hosting, authentication, payment, and AI model providers. We are not responsible for outages or changes caused by those providers.

We do not guarantee uninterrupted availability, specific response times, or that the service will be error-free.

You may stop using the service at any time. We may suspend or terminate access if you violate these terms, create risk for the service or other users, or where required for legal or security reasons.

Sections that by their nature should survive termination, including ownership, payment obligations, disclaimers, limitation of liability, and dispute terms, will survive.

Listaily is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee business outcomes, ranking performance, conversion rates, compliance approval, or marketplace acceptance of any generated content.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities.

Our aggregate liability arising out of or relating to the service will not exceed the amount you paid us for the service during the twelve months before the event giving rise to the claim.

We may update these terms from time to time. If we make material changes, we may provide notice through the service or by other reasonable means.

Your continued use of Listaily after the updated terms become effective means you accept the revised terms.
